Here we explain, with no small print, what data of yours we process, what for, for how long and what you can do about it. Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD) apply.
1. Data controller
- Controller: EVERNOA SL, Tax ID (NIF) B21891734
- Address: Calle Vereda, 23, 03688 Hondón de las Nieves, Alicante, Spain
- Contact for privacy matters: hola@everhome.es
2. What data we process and what for
We only process the data you give us and what is strictly necessary to help you:
- When you write to us or request a feasibility study: name, email address, telephone, country of residence and the information you tell us about your plot and your project. We use it to reply to you, assess whether we can help and prepare a proposal.
- When you request a call through the form: name, telephone, email, language, how and when you prefer us to contact you, and your answers about plot, project, house size and budget. We use it to prepare the call and suggest something that fits what you are looking for.
- When you download a guide: name, email, country and whether you have a plot, to send you the guide. We will only send you further communications if you expressly agree.
- If you subscribe to our communications: your email, to send you news and content about building your home. You can unsubscribe at any time from the email itself.
- If you go on to sign a contract with us: the data needed for the quote, the contract, invoicing, licence applications and the execution and guarantee of the build.
We do not make automated decisions or create profiles with your data.
3. Why we can process it (legal basis)
- Your request: replying to what you ask and preparing a proposal are pre-contractual steps taken at your request (art. 6.1.b GDPR).
- The contract: if you sign a contract, carrying out what has been signed (art. 6.1.b GDPR).
- Your consent: to send you commercial communications or the downloadable guide (art. 6.1.a GDPR). You can withdraw it whenever you wish, without affecting processing carried out before.
- Legal obligations: invoicing, accounting and keeping the construction documentation (art. 6.1.c GDPR).
4. How long we keep it
- Requests that do not lead to a contract: up to 12 months from the last contact, in case you resume the project. After that it is deleted.
- Commercial communications: until you unsubscribe.
- Clients: for the duration of the contractual relationship and, afterwards, for the periods required by law. These include six years for accounting and tax documentation, and the statutory liability periods for the build in the case of its documentation.
5. Who we share it with
We do not sell or pass on your data. Only the following have access to it:
- Suppliers who provide services to us under a data processing agreement and only for that service: website hosting and email (Dondominio, a provider based in Spain) and our tax and accounting advisers.
- WhatsApp, only if you choose that channel to talk to us. The conversation is handled through WhatsApp Ireland Limited, under its own terms of use and privacy policy.
- The professionals involved in your project if you sign a contract (architect, building surveyor, testing laboratory, utility companies), to the extent needed for your build.
- Public authorities (town hall, Spanish Tax Agency), when required by law or by your licence application.
If any supplier were outside the European Economic Area, we would only work with them if they provide the safeguards required by the GDPR, such as an adequacy decision or the European Commission’s standard contractual clauses.
6. Your rights
You can ask us at any time to access your data, rectify it, erase it, object to its processing, restrict it or receive it in a portable format, and to withdraw your consent. Write to us at hola@everhome.es stating which right you wish to exercise. We will reply within one month at most.
If you believe we have not handled your data properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
7. Security and minors
We apply technical and organisational measures to protect your data against loss, unauthorised access or misuse. The website is not aimed at children under 14 and we do not knowingly process their data.
8. Google fonts
To display the typefaces, the website loads them from Google Fonts. When it does so, your browser connects to Google’s servers, which receive your IP address. No cookies are set for this purpose.
9. Changes to this policy
If we change the way we process your data, we will update this page and the date at the top. If the change is significant, we will let you know.
